General terms and conditions for the SOPHIS e-website of SOPHIS bv
These general terms and conditions apply to all transactions concluded online with SOPHIS bv. Please read these carefully before placing an order. All agreements are subject to and interpreted in accordance with Belgian law. Furthermore, all disputes between us will be settled exclusively by the Belgian courts. Nothing in these terms and conditions will be deemed to affect your statutory rights.
By using this website you agree to these terms and conditions. All transactions with SOPHIS bv are subject to these general terms and conditions.

'The company', 'we' or 'us/our' always refers to SOPHIS bv. 'The customer' always refers to the person or persons who purchase goods from the company or agree to purchase goods. Any reference to the website implies a reference to all URLs owned by SOPHIS bv.


Prices
All prices are in euros. They include VAT at the applicable rate, unless clearly stated otherwise. All prices are subject to change without notice.


Orders
To purchase a product, you must first add the product to your shopping cart. Once you have added the desired products to your shopping cart, you can enter your contact details and billing details. You must then provide us with the necessary information for payment of the products. If we have received all the previous information, you will receive an overview page. If you accept this, your purchase is final. The purchase agreement can be concluded in the language of the website in which you purchase.
We accept orders via online transactions (secure server). All credit and debit card transactions are subject to validation checks and approval by the card issuer. We accept Visa, MasterCard, Maestro, Bancontact/Mister Cash, KBC Online/CBC Online, ING Homepay, Dexia Direct Net, iDEAL and PayPal. If the issuer of your card refuses to accept your payment to us, we cannot be held responsible for any delays in delivery and/or non-delivery of your order. Orders without valid payment made in the name of the registered cardholder will not be accepted or processed.

Please note: minors (under 18 years of age) are not allowed to purchase unless they have permission from their parents or guardian.

Delivery
Ordered products will be delivered as quickly as possible in accordance with the requested delivery method. All delivery charges are subject to change without notice. We make every effort to ensure that you receive your order within the estimated delivery time. The maximum delivery period is 30 days, starting from the day after your order. All goods are delivered subject to their availability. Promotions always run during the indicated period or while supplies last. If we are unable to deliver your goods within 30 days, we will notify you immediately and advise you of the expected delivery date. If we are unable to deliver the goods within 30 days, you may cancel the undelivered orders/products at any time after being notified of the late delivery. If payment has already been made, you will receive a full refund for the item(s) in question. If the goods delivered by us were damaged during transport, do not correspond to the items stated on the delivery note or do not correspond to the items you ordered, you must report this and return the items to us within 14 calendar days after their receipt. If we do not receive such notification, the customer will be deemed to have accepted the items as satisfactory. We cannot be held responsible for any consequential damages due to late delivery or non-delivery by the carrier appointed by the company. Our liability in such cases is limited to the value of the items which are proven not to have been received by the customer.

Returning and exchanging items
We want you to be completely satisfied with every purchase from SOPHIS bv and strive to offer you excellent quality, value for money and excellent service at all times. If you wish to return an item for an exchange, or if you have decided not to keep it, please complete the returns note you received upon delivery and return it to us within 14 calendar days, together with the products in their original packaging and with the label. When appropriate, we will exchange the item(s) or refund the cost price. All goods must be returned in new and unused condition, together with a copy of your original delivery note.
If you wish to return an item because it is damaged, please complete the details on the returns note with a description of the damage and return it to us within 14 calendar days together with the item in its original packaging. When appropriate, we will exchange the item or refund the full cost, including all delivery costs incurred. The customer is responsible for the shipping of the goods.

Guarantee
All products are covered by a warranty against defects resulting from manufacturing or material errors. The warranty lasts 24 months from the date of the initial invoice (unless otherwise stated). Defects caused by accidents, negligence or misuse are not covered by the warranty.

If you have received a product in damaged condition, please inform us first. You can contact us via info@sophis.be. We will see how we can provide a solution and will ask you to return the item. In this case, the return costs will be refunded (according to standard postal rates). Send the damaged product, together with the return invoice and a description of the damage, with sufficient postage to our return address. Please also include your account number so that we can issue the refund.

Please also clearly indicate what is wrong with the purchased product, or indicate where something is wrong. All items must be returned to us in a neat and orderly condition so that we can assist you as quickly as possible.

Products
All products are sold alone unless otherwise stated and are not always available at every point of sale. We make every effort to ensure that the colors on the website match those of the actual product as closely as possible. Due to technical limitations, certain colors may differ.

Distance selling regulations
In accordance with the distance selling regulations, you have the right, within 14 calendar days from the day after the delivery date, to cancel any order you have placed via the website with a view to a refund, provided that the goods are unused. This does not apply to perishable goods, unsealed software or items that have been personalized or created according to your instructions.
To cancel an item, you can send us an email at info@sophis.be informing us of your customer number and the order number. You must take reasonable care of the items and retain all original packaging and you must not use the items. The items must be returned within 14 calendar days after you send us your cancellation notice. They can be returned to our customer service (see contact details). All items will be returned at your expense. In the case of damaged or incorrect items, we will refund the costs upon receipt of the items. If we receive the items in unused condition and in their original packaging with all accessories, you will receive the refund within 30 days of your cancellation notice.

Force majeur
We will not be responsible for any failure to perform our obligations arising out of or occasioned by labor disputes or any other circumstances beyond the reasonable control of the Company, such as acts of God, civil commotion, flood, fire, strike, lockout, problems finding transportation and the enactment of laws. If, due to such circumstances, it becomes impossible for the company to deliver the ordered items in whole or in part within a reasonable period of time, the customer's liability is limited to the value of the items already delivered, plus any associated delivery costs.

Any information contained on our website(s) or contained in any printed material of the Company is not considered binding or recognized as best practice. It should only be regarded as useful additional advice to other recognized practice guidelines. All information on our website is regularly updated.

Prices and printing errors
We check prices and specifications to the best of our ability. While every effort is made to ensure their accuracy, we accept no responsibility for errors or omissions. We reserve the right to change our prices and specifications without notice.

Ownership of goods
All items delivered to the customer remain the property of SOPHIS bv until payment of all amounts due for the items in question has been received by us.

Questions or complaints
All questions, complaints or comments can be sent to our customer service via info@sophis.be. We will make every effort to handle your complaint within 5 working days of receipt. If we cannot resolve your complaint immediately, we will inform you of the expected deadline. We will keep you informed of every investigation.
You can also report complaints and disputes via the European ODR (Online Dispute Resolution) Platform. The ODR website is http://ec.europa.eu/odr .

Safety
We make every effort to ensure maximum protection for the users of our online ordering service. We use SSL (secure socket layer) technology to protect your information during all sales transactions with us. All information you provide is fully encrypted so that third parties cannot read it. (For Netscape, click the 'security icon' at the bottom of the toolbar and verify that SSL2 and SSL3 are checked. For Internet Explorer, go to View, Menu and Internet Options, and click on 'Advanced'. There, check whether SSL2 and SSL3 is checked. Your browser will then confirm that you are working in a secure environment: an icon with a closed padlock, or the image of a key, will appear on the bar at the bottom of your screen.)

Right of withdrawal
You have the right to withdraw from the agreement within 14 days without giving reasons. The withdrawal period expires 14 days after the day on which you or a third party designated by you, who is not the carrier, acquires physical possession of the last good.
To exercise the right of withdrawal, you must inform us SOPHIS bv, Klein Heiken 5, 2180 Ekeren, +32 497 49 25 24, info@sophis.be via an unambiguous statement (e.g. in writing by post, fax or e-mail) at inform you of your decision to withdraw from the contract. You can use the attached model withdrawal form for this, but you are not obliged to do so.
To comply with the withdrawal period, it is sufficient to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of the revocation
If you revoke the agreement, you will receive all payments you have made up to that time, including delivery costs (with the exception of any additional costs resulting from your choice of a different method of delivery than the cheapest standard delivery offered by us) without delay and in any case, no later than 14 days after we have been informed of your decision to withdraw from the contract. We will refund you using the same payment method you used for the original transaction, unless you have expressly agreed otherwise; in any case, you will not be charged any fees for such reimbursement.
We may wait with reimbursement until we have received the goods back or you have demonstrated that you have returned the goods, whichever comes first.
You must return or hand over the goods to us without delay, but in any case no later than 14 days after the day on which you communicate your decision to withdraw from the contract to us. You are on time if you return the goods before the period of 14 days has expired.
